Joint Sole Agency (Apportioned Commission)

Notwithstanding anything in this Agreement to the contrary, the parties acknowledge and agree that:

(1)

subject to a Joint Agent Annexure being completed, this Exclusive Selling Agency Agreement is a Joint Sole Agency Agreement with [insert name of Joint Agent];

(2)

the completed Joint Agent Annexure is incorporated into and forms part of this Agreement;

(3)

should [insert name of Agent]:

 

(a)

sell the property during the Exclusive Agency Period; or

 

(b)

be the Agent who effectively introduced the property to a purchaser who purchased the property either during or after the Non-Exclusive Agency Period,

 

[insert name of Agent] shall be entitled to [Insert %] of the commission, and [insert name of Agent] shall be entitled to [Insert %] of the commission.

(4)

should [insert name of Joint Agent]:

 

(a)

sell the property during the Exclusive Agency Period; or

 

(b)

be the Agent who effectively introduced the property to a purchaser who purchased the property either during or after the Non-Exclusive Agency Period,

 

[insert name of Joint Agent] shall be entitled to [Insert %] of the commission, and [insert name of Agent] shall be entitled to [Insert %] of the commission.

Joint Sole Agency (Full Commission to Agent Who Sold Property)

Notwithstanding anything in this Agreement to the contrary, the parties acknowledge and agree that:

(1)

subject to a Joint Agent Annexure being completed, this Exclusive Selling Agency Agreement is a Joint Sole Agency Agreement with [insert name of Joint Agent];

(2)

the completed Joint Agent Annexure is incorporated into and forms part of this Agreement;

(3)

should [insert name of Agent]:

 

(a)

sell the property during the Exclusive Agency Period; or

 

(b)

be the Agent who effectively introduced the property to a purchaser who purchased the property either during or after the Non-Exclusive Agency Period,

 

the Vendor is to pay [insert name of Agent] the entirety of the commission, with [insert name of Joint Agent] not being entitled to any of the commission.

(4)

should [insert name of Joint Agent]:

 

(a)

sell the property during the Exclusive Agency Period; or

 

(b)

be the Agent who effectively introduced the property to a purchaser who purchased the property either during or after the Non-Exclusive Agency Period,

 

the Vendor is to pay [insert name of Joint Agent] the entirety of the commission, with [insert name of Agent] not being entitled to any of the commission.

Joint Sole Agency (Joint Agent Commission Only)

Notwithstanding anything in this Agreement to the contrary, the parties acknowledge and agree that:

(1)

subject to a Joint Agent Annexure being completed, this Exclusive Selling Agency Agreement is a Joint Sole Agency Agreement with [insert name of Joint Agent];

(2)

the completed Joint Agent Annexure is incorporated into and forms part of this Agreement;

(3)

should [insert name of Agent]:

 

(a)

sell the property during the Exclusive Agency Period; or

 

(b)

be the Agent who effectively introduced the property to a purchaser who purchased the property either during or after the Non-Exclusive Agency Period, the commission payable shall be apportioned as follows:
