If you wish to reclaim the goods, you must do so before the end of the notice this stipulated time period stipulated in the following item and you may be liable for payment, to the former Landlord/Agent, of any relevant charges as provided for in section 28 of the Act of an occupation Fee (The Act, Section 132).

 

DISPOSAL OF NON PERISHABLE GOODS (OTHER THAN PERSONAL DOCUMENTS)

Failure by the Former Tenant to collect or make arrangements to collect the goods after theis time notice period specified above in this Item will result in the goods being disposed of by the Landlord/Agent in accordance with the Act by sale or other lawful manner.

Low value goods (less than $1,000) – 14 days after the day on which notice was served (see section 20)

Medium value goods (more than $1,000 but less than $20,000) – 28 days after the day on which notice was served (see section 21)

Note: goods with a value of at least $20,000 (high value goods) – require an order of the Tribunal.

Personal documents – 28 days after the day on which notice was served (see section 22A)

Note: The Landlord/Agent will not dispose of documents in any manner that results in personal information becoming publicly available.

If the goods are sold:

The Landlord/Agent is entitled to deduct from the sale proceeds the reasonable costs relevant charges as provided in section 28 of the Act of sale and an Occupation Fee (The Act, Section 132).

Proceeds remaining after the above payments will, if requested by the Former Tenant or other person entitled thereto, be paid to the Former Tenant or other person.

 

DISPOSAL OF PERSONAL DOCUMENTS

Failure to collect or make arrangements to collect personal documents after this time will result in the documents being disposed of by the Landlord/ Agent in the following manner:

by returning them to the authority that issued the documents

if it is not reasonably practicable to return them to that authority, in any other lawful manner that the Landlord/ Agent  thinks fit.

Note:  The Landlord/Agent will not dispose of documents in any manner that results in personal information becoming publicly available.
