The Prospective Buyer/s, prior to making an offer to purchase the Property/Business in Item (3), acknowledges they are aware that other parties are interested in purchasing the Property/Business in Item (3) and may also make confidential offers to the Seller.
The Prospective Buyer/s confirm that:

they are in a position to proceed to Contract immediately should their offer be accepted

the Listing Agent has advised them to put forward their best offer in writing (prior to the closing date where applicable), to be given to the Seller.

all offers by Prospective Buyers will be presented to the Seller by the Listing Agent

they are aware that any offer may be accepted or rejected at the Seller’s discretion.

they are aware the Seller is not obligated to accept any offer.

and that the Seller may (but is not obliged to) negotiate with any Prospective Buyers.

details of their offer will remain confidential to the Prospective Buyer/s (Item 2) and the Listing Agent in Item (1) who will present the offer to the Seller.
